Privacy Policy

How we handle personal information across our websites, platform, and connected services.

ATC Capital Partners LLC, doing business as ATC Analytics (“ATC,” “we,” “our,” or “us”), provides account intelligence, professional contact research, sales planning, and related services to business customers. This policy explains how we handle personal information through our websites, platform, APIs, and ATC connections to ChatGPT and other AI applications (together, the “Services”).

1. Who this policy covers

This policy covers visitors, account holders, people who contact ATC, and individuals whose professional information is processed through the Services, including people who do not have an ATC account.

ATC determines how personal information is used for its own account administration, security, service operations, and independently maintained research. When we process customer-provided personal information on a business customer's instructions, our role and obligations are governed by the applicable customer agreement and data processing terms. The customer may be responsible for handling requests about that information. You may contact us if you are unsure which organization to contact.

This policy describes ATC's practices. ChatGPT and other AI applications, connected outreach platforms, and other independent services also have their own privacy policies.

2. Information we collect and its sources

Activity and technical informationThe user or account invoking an operation; the tool or endpoint used; account/product context; time, outcome, response size, performance information, usage and credit records; and IP address, browser/device information, and website interactions. Request IP addresses may identify an intermediary service rather than your device.
Integration informationYour selected provider, connection identifiers and authorization tokens, recipient and sequence selections, and transmission or enrollment history. Authorization information is used to operate the connection.
Commercial account recordsService plans, credit balances, usage charges, and transaction or billing references associated with your account and any purchases completed outside the AI connection.
CommunicationsSupport requests, feedback, service notifications, contact details, and correspondence with ATC.

We receive information directly from you, through your business organization and authorized integrations, automatically when you use the Services, and from research and professional-information sources. Information about a company can also be personal information when it identifies an individual.

3. What ATC receives through ChatGPT and other AI applications

An ATC connection receives the tool arguments and resources that the AI application sends to perform an operation. These can include text or context taken from your request, selected companies or contacts, or a draft you ask ATC to use. The connection does not give ATC access to your complete conversation history, and ATC does not retrieve or reconstruct that history through the connection.

We return the requested results to the AI application. ATC may retain research, professional contact information, generated drafts, saved results, and the limited activity records described in this policy. Generated ATC results and supplied task content are distinct from a complete transcript of your conversation or every response produced by your AI application.

We record endpoint/user activity for service operation, security, usage accounting, and troubleshooting. We configure operational diagnostics to limit copies of task content. This does not mean that research or drafts needed for the product are never stored, or that every technical record is anonymous.

4. How we use information

We use information to:

  • Authenticate users, administer accounts and workspaces, and maintain authorized integrations.
  • Research accounts and professional contacts, assess relevance, prepare meeting materials, and generate requested outreach content.
  • Save results, resume work, maintain history, and perform actions requested through the Services.
  • Track usage and entitlements, maintain reliability, investigate problems, and prevent fraud, abuse, and unauthorized access.
  • Understand website and product use and improve service performance and usability.
  • Respond to support and privacy requests and send operational communications.
  • Meet legal obligations, resolve disputes, and protect legal rights.

We use hosted AI services for research and generation. Depending on the operation, they receive selected task content, seller context, professional information, research excerpts, or drafts needed to produce the result. Search and research providers may receive relevant company, product, role, or contact queries. AI-generated information can be inaccurate; correction requests are available through the contact in Section 8.

5. Who receives information

Payment and billing providersRelevant account and transaction information is processed to handle payments and maintain commercial account records for transactions outside the AI connection.
Your organization and authorized usersCustomer content and results are available according to the relevant workspace permissions and the customer's administration of its account.
Your AI applicationRequested results are returned to the application through which you invoked ATC.
Connected outreach services and intended recipientsWhen an outreach action is requested, selected contact details, drafts, and sequence information are sent to the chosen provider. Enrollment can lead to delivery to the selected recipients under that provider's configuration.
Other customers receiving professional researchThe Services may provide professional contact information and research to customers requesting relevant business intelligence. This is separate from sharing your private workspace content. See Section 9 for more information about these disclosures and your choices.

We may also disclose information when required by law, to respond to lawful requests, to protect rights or safety, or in connection with a business transaction such as a merger or asset sale. Where necessary, additional uses or disclosures require appropriate notice or consent.

Service-related support notifications

When a request requires missing ideal-customer-profile data, the Services may create a support request and email ATC support with the requesting user's name and email, the relevant product, and request details. An operation that exhausts an account's credit allowance may also notify ATC support with the user's email, the relevant application, and remaining balance. Reading a credit balance alone does not trigger that notification.

These notifications may leave copies with our email provider and in our support mailbox. They are operational communications, distinct from outreach to a prospect.

6. Security

We use technical and organizational safeguards appropriate to the Services, including encrypted network connections and access controls for authenticated and staff functions. Access to personal information is limited according to authorized responsibilities. No system can guarantee absolute security.

7. Retention and deletion

We retain information according to the periods below, subject to the limited exceptions described after the table.

Saved content and account/workspace informationRetained while the account or workspace remains active, unless deletion is requested sooner. Applicable information is deleted from active systems within 30 days after account closure or verification of a deletion request, subject to lawful exceptions and authority over shared content.
Minimal outreach transmission/enrollment historyUp to 180 days after the event. This does not extend retention of draft content.
Support correspondenceUp to 90 days after the matter closes.
BackupsExpire within 35 days after creation. Deleted information may remain in backups for up to 35 additional days after active-system deletion.
Billing and accounting records7 years after the end of the calendar year containing the transaction, limited to invoices, payments, and credit debit/refund records.

Where a legal obligation, specific dispute, or security investigation requires longer retention, we retain only the relevant information, restrict its use to that purpose, and delete it when the reason for retention ends. If a backup is restored, we reapply applicable deletion requests before returning restored information to ordinary use.

Removing a company from a saved list or disconnecting an integration is not a request to erase all associated research, history, or provider records. Disconnecting ATC from an AI application also does not delete previously stored information. Use the privacy-request process below for broader deletion.

Recipients of delivered messages and independent connected services control their own copies. ATC cannot retract a delivered message or guarantee deletion from an independent recipient's systems. We handle requests relating to our service providers through the applicable provider process.

8. Your choices and privacy requests

Contact contact@atc-cp.com or write to the address above to ask about your information, request access or correction, request deletion, or raise a privacy concern. Professional contacts who do not have an ATC account may also contact us. Our support team monitors the privacy contact address. Use the subject “Privacy request” and identify the information or account involved without sending passwords, access tokens, or unnecessary sensitive documents.

Depending on applicable law, your rights may include access, a portable copy, correction, deletion, restrictions on processing, and objection or opt-out rights for certain uses or disclosures. You may also have rights to withdraw consent, appeal a request decision, use an authorized representative, or complain to a regulator. We will assess and respond to requests under the law that applies and explain relevant limitations. We do not penalize you for exercising applicable privacy rights.

We may verify your identity and authority in proportion to the request. If your organization controls the relevant information, we may refer the request to it or assist it in responding. If you wish to appeal a decision where that right applies, contact the same privacy address with the subject “Privacy appeal.”

You can remove entries from saved lists and disconnect integrations using the product controls provided. Those actions have the limited scope described in Section 7. Browser cookie controls can affect website features, but do not stop necessary server-side security or usage-accounting records.

9. Website analytics, cookies, and professional-information disclosures

Our websites use cookies and related technologies for authentication, session management, and measurement. Where enabled, analytics and session-replay services may process visited pages, interaction events, technical information, and account identifiers, including name or email where configured. Session replay can record or reconstruct interactions with website content. These website services are separate from the ATC tool connection inside ChatGPT.

You can use your browser settings to block or delete cookies. These settings may affect website functionality and do not remove information already collected. For questions about analytics or requests relating to information collected through these tools, use the privacy contact in Section 8.

The Services disclose professional names, job titles, employers, business contact details, professional profile links, and related research to business customers as described in Sections 2 and 5. These disclosures may constitute a “sale” of personal information under applicable privacy laws. This is separate from sharing private customer workspace content.

To request an opt-out of disclosures of your professional information, or to exercise an applicable right to opt out of sale, sharing, or targeted advertising, email contact@atc-cp.com with the subject “Privacy opt-out.” Include enough information for us to identify the relevant record. We will assess your request under applicable law and explain any limitations, as described in Section 8.

10. International processing

Information may be processed in the United States and other countries where ATC or its providers operate. Protections may differ between countries. You may contact us at the address in Section 8 for information about the processing of your personal information and any safeguards applicable to its transfer.

11. Children

The Services are intended for business and professional use and are not directed to children under 13. If you believe a child under 13 has provided personal information to ATC, contact us so we can investigate and take appropriate action.

12. Changes and contact

We may update this policy as our practices change. We will update the effective or last-updated date and provide additional notice where required. A policy update does not replace any consent required for a new use of information.
